Record-Keeping Requirements Exemption
18 U.S.C. § 2257 and 28 C.F.R. Part 75 require certain record-keeping obligations for producers of “actual sexually explicit conduct.” 40UP is not a producer of any visual content displayed on this website and is therefore exempt from the record-keeping requirements of 18 U.S.C. § 2257.
About This Site
40UP is a directory service that displays listings submitted by independent third-party users. We do not:
- Produce, create, film, or commission any visual depictions of sexually explicit conduct
- Host or store sexually explicit images or videos on our servers
- Employ or contract with any performers or models
- Direct, manage, or control the creation of any user-submitted content
All content displayed on 40UP originates from independent providers who submit their own listings and images. These providers are solely responsible for compliance with all applicable record-keeping requirements under 18 U.S.C. § 2257.
Age Verification
All persons depicted in any visual content on this Site were at least 18 years of age at the time of the creation of such depictions. 40UP’s platform is specifically designed for providers aged 40 and over. We do not knowingly allow listings from individuals under the age of 40, and strictly prohibit any content involving individuals under the age of 18.
Third-Party Content Providers
Each individual provider who posts content to 40UP is responsible for:
- Maintaining any records required under 18 U.S.C. § 2257 for content they produce
- Ensuring all persons depicted in their content are at least 18 years of age
- Complying with all applicable federal, state, and local laws
