By accessing or using 40UP (“the Site”), you agree to be bound by these Terms of Service. If you do not agree, you must stop using the Site immediately. We reserve the right to update these terms at any time. Continued use of the Site after changes constitutes acceptance of the revised terms.

40UP is an online directory that features adult companion listings from independent providers aged 40 and over. The Site aggregates and displays content submitted by third-party users. 40UP does not create, verify, endorse, or guarantee any listing, provider, or service advertised on the Site.
3. Eligibility
You must be at least 18 years of age to access or use this Site. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these terms. If you are a provider posting listings, you must be at least 40 years of age.
4. User Conduct
You agree not to:
- Post any content involving minors or references to underage individuals
- Engage in or promote human trafficking, coercion, or exploitation
- Post fraudulent, misleading, or deceptive listings
- Use stolen photos or impersonate another person
- Post explicit pricing for sexual services
- Harass, threaten, or abuse other users
- Attempt to circumvent any security measures on the Site
- Use the Site for any purpose that violates applicable law
5. Content and Listings
All listings on 40UP are created and submitted by independent third parties. 40UP does not control, endorse, or assume responsibility for any user-generated content. We reserve the right to remove any listing at our sole discretion, with or without notice, for any reason including but not limited to violation of these terms or our Community Guidelines.
6. Intellectual Property
The Site’s design, branding, code, and original content are the property of 40UP and are protected by applicable copyright and trademark laws. User-submitted content remains the property of the respective users, but by posting on 40UP you grant us a non-exclusive, royalty-free license to display and distribute that content on the Site.
7. Disclaimer of Warranties
The Site is provided “as is” and “as available” without warranties of any kind, either express or implied. 40UP makes no representations or warranties regarding the accuracy, completeness, or reliability of any listing or content on the Site. Use of the Site is at your own risk.
8. Limitation of Liability
To the fullest extent permitted by law, 40UP and its owners, operators, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Site, your interactions with any provider or user, or your reliance on any content displayed on the Site.
9. Indemnification
You agree to indemnify and hold harmless 40UP, its owners, operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Site, your violation of these terms, or your violation of any third-party rights.
10. Termination
